Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and Cluster Protocol (“Cluster,” “we,” “us,” or “our”), governing your access to and use of the Cluster Protocol platform located at hub.clusterprotocol.ai and all related APIs, tools, SDKs, and services (collectively, the “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Services.

2. Eligibility

You must be at least 18 years old and possess the legal capacity to enter into binding contracts under the laws of your jurisdiction. By accessing the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Platform Description

Cluster Protocol is a decentralized AI inference infrastructure platform. The Services enable users to:

  • Access AI model inference endpoints via a unified API
  • Route inference requests across multiple compute providers
  • Pay for inference usage through x402 micropayments (USDC on Base network)
  • Upload, host, and monetize AI models
  • Access and purchase datasets from the data marketplace

You acknowledge that Cluster Protocol operates as a non-custodial, infrastructure-layer protocol and does not control or operate the underlying AI models, blockchain networks, or third-party compute providers.

4. Account and API Access

To use certain features of the Services, you may be required to create an account and obtain API keys. You agree to:

  • Provide accurate and current information during registration
  • Maintain the confidentiality of your API keys and credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account at our sole discretion if we determine that you have violated these Terms or engaged in any activity that may harm the platform or other users.

5. Payments and Fees

x402 Micropayments

The Services utilize the x402 payment protocol for per-request micropayments denominated in USDC on the Base network. By using paid endpoints, you authorize automatic per-request settlement from your connected wallet.

Pricing

Current pricing for each endpoint is displayed in the API documentation and returned in HTTP 402 response headers. Prices are subject to change. Continued use after a price change constitutes acceptance of the new pricing.

Refunds

All payments are final and non-refundable. Due to the nature of on-chain settlement and immediate inference delivery, we cannot reverse completed transactions.

6. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable laws, regulations, or sanctions
  • Generate content that is illegal, harmful, abusive, defamatory, or promotes violence
  • Infringe upon the intellectual property or privacy rights of any third party
  • Distribute malware, viruses, or other harmful code
  • Attempt to circumvent rate limits, access controls, or payment mechanisms
  • Reverse-engineer, decompile, or attempt to extract source code from the platform
  • Engage in any activity that disrupts or interferes with the operation of the Services
  • Use automated means to scrape or extract data beyond authorized API usage

We reserve the right to investigate and take appropriate action against any suspected violations, including account termination and reporting to law enforcement authorities.

7. Intellectual Property

All content, code, design elements, trademarks, logos, and documentation associated with Cluster Protocol are the exclusive property of Cluster Protocol or its licensors and are protected under applicable intellectual property laws.

You retain ownership of any content you submit to the platform (e.g., model weights, datasets). By uploading content, you grant Cluster Protocol a non-exclusive, worldwide license to host, distribute, and make available your content through the Services as directed by you.

8. Third-Party Services

The Services integrate with and route requests to third-party infrastructure including but not limited to AI model providers, blockchain networks (Base, Ethereum), wallet providers, and decentralized protocols. You acknowledge that:

  • We are not responsible for the availability or performance of third-party services
  • Third-party services are subject to their own terms and conditions
  • We make no warranties regarding the accuracy or reliability of third-party model outputs

9. Digital Wallets

Use of the Services may require connection to a compatible digital wallet (e.g., MetaMask, Coinbase Wallet). You acknowledge and agree that:

  • Cluster Protocol does not custody, control, or have access to your wallet, private keys, or seed phrases
  • You are solely responsible for securing your wallet credentials
  • We cannot recover lost keys or reverse blockchain transactions
  • You bear all risk associated with the use of digital assets and blockchain networks

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of AI model outputs
  • Uninterrupted, secure, or error-free operation of the Services
  • Results obtained from the use of the Services meeting your requirements

AI-generated outputs may be inaccurate, biased, or incomplete. You are solely responsible for evaluating and validating any outputs before reliance or further use.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLUSTER PROTOCOL AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, consequential, incidental, special, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Unauthorized access to or alteration of your data or wallet
  • Errors, bugs, or disruptions in the Services or underlying blockchain networks
  • Actions or omissions of third-party providers

In no event shall our total aggregate liability to you exceed the greater of (a) US$100 or (b) the total fees paid by you to Cluster Protocol in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cluster Protocol and its affiliates, officers, and employees from and against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Services
  • Your breach of these Terms
  • Your violation of any applicable law or third-party rights
  • Content you upload, generate, or distribute through the platform

13. Modifications and Termination

We may modify these Terms at any time at our sole discretion. Updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Services after any modification constitutes acceptance of the revised Terms.

We may suspend, discontinue, or modify any part of the Services at any time without prior notice and without liability to you. We may also terminate or suspend your access at our discretion for any reason, including violation of these Terms.

14. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of laws principles.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver

Failure by Cluster Protocol to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cluster Protocol regarding the use of the Services.
